What is saisie immobilière in France?

Saisie immobilière is the mortgage enforcement procedure under French law, governed by the Code des procédures civiles d’exécution. It begins with the commandement de payer valant saisie served on the debtor, followed by an orientation hearing before the Juge de l’exécution (JEX), who decides whether the sale will be by judicial auction or amicably. The process can last between 12 and 24 months.
What are the French public financial institutions?

The French public financial institutions are State bodies that manage regulated savings funds, pension funds and the financing of projects of general interest. In contentious matters, they act as creditors in proceedings to recover credits granted through their financing instruments. Our office has specific experience in representing these institutions before the French courts.
What does the banks’ devoir de mise en garde consist of?

The devoir de mise en garde is the obligation a bank has to warn its customers about the risks of a credit when it is disproportionate to their financial capacity. Failure to comply can give rise to banking liability claims by the customer. We defend banks against these claims, analysing whether the warning obligation was properly fulfilled in accordance with the case law of the Cour de cassation.

Which courts hear banking disputes in France?

Banking disputes in France are heard primarily before the Tribunal judiciaire (formerly the Tribunal de grande instance) for significant credits, and before the Tribunal de commerce for disputes between commercial entities. The Juge de l’exécution (JEX) has jurisdiction over enforcement proceedings. On appeal, the Cour d’appel de Toulouse for matters in the Occitanie region.
