Conflicts of Interest

[PENDIENTE_RAZON_SOCIAL]’s policy for the identification, prevention and management of conflicts of interest, in accordance with the General Statute of the Spanish Bar and the Code of Ethics of the Spanish Bar.

Definition of conflict of interest

A conflict of interest exists when the professional or personal interests of [PENDIENTE_RAZON_SOCIAL] or of any of its professionals may interfere, actually or apparently, with the duty of loyalty and diligence owed to the client.

Prior identification

Before accepting any new engagement, the firm performs a conflict check that verifies:

  • Whether the firm has advised or is currently advising the opposing party in the same matter or in a related one.
  • Whether significant personal, family or financial relationships exist between any firm professional and the parties involved.
  • Whether the professionals assigned to the matter have other engagements whose course could be affected.

Conflict management

When a conflict is identified, the firm assesses whether it can be managed through appropriate measures (information walls, change of assigned professional, written informed consent of the affected parties) or whether, due to its nature or seriousness, the engagement must be declined.

Informed consent

In cases where the conflict can be managed, [PENDIENTE_RAZON_SOCIAL] informs the affected parties in writing about the nature of the conflict and the measures adopted, and seeks their express consent to continue the service.

Disclosure of subsequent conflicts

Any conflict identified after the start of an engagement will be communicated to the client immediately, along with the proposed corrective measures. The client may at any time request information on the conflicts policy by emailing compliance@jurisserv.com.
